Rights to Use Macave

Unless otherwise stated, Macave owns the intellectual property rights in the website and the material on the website.

You may view, download for caching, and print pages from the website for your own use, subject to the restrictions set out below and elsewhere in these terms.

You must not:

  • republish material from this website (including republishing on another website)
  • sell or rent material from the website
  • show any material from the website to the public
  • reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose
  • edit or otherwise modify any material on the website, or
  • distribute material from this website except for content specifically and expressly made available for distribution.

Acceptable Use

You must not use this website in a way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website, or in any way which is unlawful, fraudulent or harmful, or in connection with any unlawful, fraudulent or harmful purpose or activity.

You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including, without limitation, scraping, data mining, data extraction, and data harvesting) on or in relation to this website without Macave's express written consent.

You must not use this website to transmit or send unsolicited commercial communications.

You must not use this website for any purposes related to marketing without Macave's express written consent.

Restricted Access

Access to certain areas of this website is restricted. Macave reserves the right to restrict access to other areas of this website, or indeed this entire website, at Macave's discretion.

If Macave provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.

Macave may disable your user ID and password at Macave's sole discretion without notice or explanation.

Macave Premium Subscription

Plans and Pricing

Macave offers a free tier and a paid subscription ("Macave Premium"). Macave Premium is available as:

  • Monthly plan: €4.90 per month
  • Annual plan: €49 per year

All prices include applicable taxes. Macave reserves the right to change subscription prices. If prices change, you will be notified at least 30 days in advance, and the new price will apply from your next billing cycle.

Free Trial

New Premium subscribers receive a 7-day free trial. During the trial period, you have full access to all Premium features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged according to your chosen plan.

The free trial is available once per account. Macave reserves the right to modify or discontinue the free trial offer at any time.

Billing and Payment

Subscription payments are processed through our third-party payment provider, Stripe. By subscribing, you also agree to the payment provider's terms of service. Macave does not store your payment details directly.

Your subscription renews automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You are responsible for keeping your payment information current.

Premium Features

Macave Premium currently includes access to the AI-powered wine cellar assistant ("Ask your wine cellar"), which allows you to query your wine collection using natural language. Usage is limited to 50 messages per day.

Macave may add, modify, or remove Premium features over time. If a significant feature is removed, you will be notified at least 30 days in advance.

AI-Powered Features

The AI wine cellar assistant provides suggestions and recommendations based on the wine collection data you have entered into Macave. Please note:

  • AI-generated recommendations are for informational purposes only and should not be treated as professional advice (such as medical, financial, or legal advice).
  • Macave does not guarantee the accuracy, completeness, or suitability of AI-generated responses.
  • The AI assistant's responses are generated using third-party large language model services. Your wine collection data is shared with these services solely for the purpose of generating responses. Macave does not use your data to train AI models.
  • Macave reserves the right to set and adjust usage limits on AI features to ensure fair use and service quality.

Cancellation

You may cancel your Macave Premium subscription at any time through your account settings. Upon cancellation:

  • You retain access to Premium features until the end of your current billing period.
  • After the billing period ends, your account reverts to the free tier.
  • Your wine collection, tasting notes, and other data are retained and remain accessible on the free tier.
  • No partial refunds are issued for unused time within a billing period, except as required by applicable law.

Right of Withdrawal and Refunds

In accordance with EU consumer protection law (the Consumer Rights Directive), you have the right to withdraw from your subscription within 14 days of purchase for a full refund, without giving any reason. To exercise this right, contact us at thecellar@macave.se with your account details and a clear statement of your wish to withdraw.

If you have actively used Premium features during the withdrawal period, Macave may deduct a proportionate amount corresponding to the service provided up to the point of withdrawal.

Refunds will be processed using the same payment method used for the original purchase, within 14 days of receiving your withdrawal request.

Suspension and Termination

Macave may suspend or terminate your Premium subscription if:

  • Payment fails and is not resolved within a reasonable period.
  • You breach these terms of service.
  • Your use of Premium features is abusive, including but not limited to circumventing usage limits, automated or scripted use of the AI assistant, or using the service in a way that degrades it for other users.

If Macave terminates your subscription due to your breach of these terms, no refund will be issued. If Macave discontinues the Premium service entirely, you will receive a pro-rated refund for any unused prepaid period.

User Content

In these terms, "your user content" means material (including, without limitation, text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.

You grant to Macave a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to Macave the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or Macave or a third party.

You must not submit any content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

Macave reserves the right to edit or remove any material submitted to this website, or stored on Macave's servers, or hosted or published upon this website.

Notwithstanding Macave's rights under these terms in relation to user content, Macave does not undertake to monitor the submission of such content to, or the publication of such content on, this website.

No Warranties

This website is provided "as is" without any representations or warranties, express or implied. Macave makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, Macave does not warrant that:

  • this website will be constantly available, or available at all, or
  • the information on this website is complete, true, accurate or non-misleading.

Nothing on this website constitutes, or is meant to constitute, advice of any kind.

Limitations of Liability

Macave will not be liable to you in relation to the contents of, or use of, or otherwise in connection with, this website:

  • for any direct loss, except where such loss arises directly from Macave's breach of its obligations under a paid subscription, in which case liability is limited to the subscription fees paid by you in the 12 months preceding the claim
  • for any indirect, special or consequential loss, or
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Macave has been expressly advised of the potential loss.

Exceptions

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Macave's liability for:

  • death or personal injury caused by Macave's negligence;
  • fraud or fraudulent misrepresentation on the part of Macave; or
  • matter which it would be illegal or unlawful for Macave to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable.

If you do not think they are reasonable, you must not use this website.

You accept that you will not bring any claim personally against individuals behind Macave in connection with any losses you suffer in connection with the website.

Governing Law

These terms of service are governed by and construed in accordance with Swedish law. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Swedish courts.
